Statement by the Friends of the Inter-American Democratic Charter on the Honduran Coup, Sunday, June 28, 2009

Faced with the occurrence of the coup d'état in the Republic of Honduras, Sunday, June 28,

We, the Friends of the Inter-American Democratic Charter, express our great concern for the rupture of the constitutional order in the Republic of Honduras that took place on June 28, 2009.

We consider unjustifiable and unacceptable that an institutional political crisis would be resolved through an act of force. Use of force to interfere in the mandates of elected political officials has been condemned by the hemisphere since the Santiago Declaration of 1991, reiterated in the Inter-American Democratic Charter in 2001, and has no place in the 21st century. Instead, dialogue, constitutional mechanisms, legal procedures, and respect for due process should be used to resolve conflicts between branches of power or to investigate alleged illegal or unconstitutional acts by any political actor. These procedures were not followed in Honduras; nor was the OAS offer of good offices utilized.

At the same time, we recognize that disputes arose between the branches of government in recent months and days over whether and how to reform the constitution. We are aware of the defiance of the president in the wake of rulings by the Supreme Court and the Congress, but also emphasize that the president did not attempt to dissolve either of those branches of government.

In virtue of these facts, we express the following:

1. The Friends of the Inter-American Democratic Charter categorically reject the forceful action that removed President Zelaya from office.
2. The political crisis should be resolved according to the established constitutional procedures in an atmosphere of respect to all institutions.
3. The process of institutional reestablishment should begin with the reinstatement of President Zelaya, the commitment of all branches of government to respect the authority of each of the others, and respect for all proceedings established in the Honduran Constitution, particularly those for the amendment of the Constitution itself.
4. The American states should cooperate with the legitimate Honduran authorities to initiate a dialogue to resolve the political crisis and the inter-branch conflict consensually, applying constitutional mechanisms and the principles of the Inter-American Democratic Charter, in particular the rule of law, respect for the Constitution, human rights and the separation of powers.

Ante el golpe de estado ocurrido en la República de Honduras el domingo 28 de junio de 2009,

Nosotros, Amigos de la Carta Democrática Interamericana, expresamos nuestra profunda preocupación por la ruptura del orden constitucional en la República de Honduras el 28 de junio de 2009.

Consideramos injustificable e inaceptable recurrir al uso de la fuerza en procura de una solución para una crisis política e institucional. El uso de la fuerza para interrumpir el mandato de autoridades políticas electas es condenado por los países del hemisferio desde la Declaración de Santiago de 1991, ha sido reiterado en la Carta Democrática Interamericana de 2001 y resulta inadmisible en el siglo XXI. En su lugar, el diálogo, los mecanismos constitucionales, los procedimientos legales y el respeto por el debido proceso deben ser los recursos para resolver los conflictos entre los Poderes del Estado y para la investigación y tratamiento de supuestos actos o conductas ilegales o inconstitucionales por parte de cualquier autoridad o actor político. En Honduras no se acudió a dichos recursos ni al ofrecimiento de buenos oficios por parte de la Organización de Estados Americanos.

Reconocemos que surgieron discrepancias entre los Poderes del Estado en meses y días recientes sobre la viabilidad y procedimiento para reformar la constitución. Asimismo, hemos conocido de la actitud desafiante del presidente a decisiones de la Corte Suprema de Justicia y del Congreso. Sin embargo, subrayamos que el presidente no procuró la disolución de dichos Poderes del Estado.

En virtud de estos hechos expresamos lo siguiente:

1. Los Amigos de la Carta Democrática Interamericana rechazamos categóricamente la acción de fuerza mediante la cual se depuso al Presidente Zelaya.
2. La crisis política debe ser resuelta, en una atmósfera de pleno respeto a todas las instituciones, de conformidad con los procedimientos constitucionales establecidos.
3. El proceso de recomposición institucional debe iniciarse con la restitución del Presidente Zelaya, el compromiso de cada uno de los Poderes del Estado de respetar sus respectivas competencias y autoridad, y el respeto irrestricto a todos los procedimientos establecidos en la Constitución de la República de Honduras, en particular aquellos referidos a las reformas constitucionales.
4. Los Estados Americanos deberán cooperar con las autoridades legítimas de la República de Honduras para iniciar un diálogo que resuelva la crisis política y los conflictos entre Poderes de manera consensuada, aplicando los mecanismos constitucionales y los principios de la Carta Democrática Interamericana, especialmente los referidos al respeto al estado de derecho, el respeto a la Constitución, los derechos humanos y la separación de poderes.
